The SD Panthers AI Platform provides AI-powered computer vision analysis including but not limited to: optical character recognition (OCR), object detection, barcode scanning, image classification, and natural language processing.

This platform is NOT:

• A medical device (not FDA-approved or cleared)
• A diagnostic tool for medical conditions
• A replacement for professional medical, pharmaceutical, legal, or financial advice
• A validated quality control or manufacturing release system
• A substitute for qualified operators, inspectors, or professionals
• Approved for use in critical decision-making without human verification

SD Panthers LLC, its officers, directors, employees, contractors, and affiliates (collectively, "SD Panthers") assume ABSOLUTELY NO RESPONSIBILITY OR LIABILITY for:

• Medical decisions: Medication selection, dosage, patient treatment, diagnoses, or health outcomes
• Pharmaceutical decisions: Drug release, batch disposition, quality acceptance/rejection, or regulatory compliance
• Manufacturing decisions: Product release, defect acceptance, line clearance, or production approval
• Safety decisions: Equipment operation, hazard identification, or risk assessment
• Financial decisions: Investments, purchases, pricing, or economic transactions
• Legal decisions: Contract interpretation, compliance determinations, or regulatory filings
• Any other decision made in reliance on outputs from this platform

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL INFORMATION AND MAKING ALL DECISIONS.

AI systems are NOT perfect. This platform may produce:

• Incorrect OCR: Misreading text, numbers, dates, lot numbers, NDCs, GTINs, etc.
• False positives: Detecting defects, objects, or conditions that don't exist
• False negatives: Missing actual defects, hazards, or important information
• Hallucinations: Generating plausible but completely fabricated information
• Bias: Systematic errors due to training data limitations
• Inconsistency: Different results for the same input at different times

Always verify AI outputs through independent, validated means before taking action.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

SD Panthers expressly disclaims all warranties, including but not limited to:

• Merchantability: No guarantee the platform is suitable for any particular purpose
• Fitness for Purpose: No guarantee it meets your specific needs or requirements
• Accuracy: No guarantee of correct, complete, or reliable results
• Availability: No guarantee of uptime, performance, or continued access
• Security: No guarantee of data protection or breach prevention
• Non-Infringement: No guarantee the platform doesn't violate third-party rights

You agree to indemnify, defend, and hold harmless SD Panthers from any claims, damages, losses, liabilities, costs, or expenses (including attorneys' fees) arising from:

• Your use of the platform
• Decisions made based on platform outputs
• Violations of laws, regulations, or third-party rights
• Product defects, recalls, or quality failures
• Patient harm or adverse events
• Regulatory non-compliance or citations
• Any breach of this waiver or the Terms of Service

By using this platform, you agree to:

• Verify all information through independent, validated means
• Maintain proper oversight by qualified personnel
• Never use as the sole basis for critical decisions
• Comply with all applicable laws and regulations in your jurisdiction
• Implement proper validation if using in regulated environments
• Maintain appropriate insurance for your activities and risks
• Accept full responsibility for all outcomes and consequences

DO NOT upload confidential, proprietary, or sensitive information unless you accept the risk of:

• Data transmission over the internet (encryption used but not guaranteed)
• Processing by third-party AI services (Google Cloud, OpenAI, etc.)
• Potential data breaches or unauthorized access
• Storage on cloud servers (Firebase, Google Cloud)

You are responsible for redacting PII (personally identifiable information) and complying with HIPAA, GDPR, or other applicable privacy laws.

This platform may not be legal or appropriate for use in all jurisdictions. You are responsible for:

• Determining if use is permitted in your country, state, or locality
• Compliance with FDA, EMA, or other regulatory requirements
• Obtaining necessary approvals, licenses, or authorizations
• Not using the platform if prohibited in your jurisdiction

This waiver is governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Delaware.
